On the Establishment of Legal System of Environmental Pollution Liability Insurance in Our Country

本文针对我国环境污染责任保险的法律制度,提出了环境污染采取严格责任,揭示了其高额赔偿给企业带来了难以承受的压力和迫使我国要建立一种保险制度来转嫁企业的风险.为我国环境污染责任保险法律制度完善我国环境法律体系,稳定社会经济秩序,防治环境污染具有深远意义和促进作用。

The environmental pollution adopts the strict responsibility,its high compensa- tion has brought the unbearable pressure to the enterprise.This pressure forces our country to establish an insurance system for enterprises to shift the risk,and this insurance system that is the legal system of environmental pollution liability insurance.This article through the pre- liminary practice of environmental pollution liability insurance,reveals the problem which ex- poses in the preliminary practice,and shows the necessity of establishing the legal system of environmental pollution liability insurance in our country,and discusses on the related ques- tion of legal system of environmental pollution liability insurance.
