非常法制体系中的戒严法——兼谈我国戒严法的修改

Martial Law of Legal System in Special Situations ——proposal about the amendment to martial law of China

非常状态法律可以分为战争状态法律和紧急状态法律两大类,戒严法属于战争状态法律,但在特殊的紧急状态下也可以适用。我们应该以此为出发点,为戒严法重新定位、修订我国现行的戒严法。新的戒严法应当强化戒严时期的权力制约和公民权利保障与救济,重视戒严权力行使的程序,从而使戒严法在非常时期捍卫法治发挥更大的作用。

Laws in special situations contain two parts as follows:law in state of war and law in state of emergency.Martial Law belongs to the former.However,it also can be employed in case of unusual emergency.Therefore,basing on this point,Martial Law should be amended to definite it anew.That is,power restriction and citizen right ensurance and relief should be strengthened during the martial period in new Martial Law.Furthermore,the procedure in carrying out power should deserve great attention.Through such kind amendment,Martial Law could play more important role in maintaining law and order during the special period.
