On the Essence, Function and Innovation of the Institution

制度的本质在于形式合理性和实质公正性 ,它具有规范性和秩序性、合理性和合法性分配、导向性和激励性、协调性和整合性等主要功能。制度的形式合理性与实质公正性发生矛盾时 ,就产生制度的结构性和功能性失效 ,因而需要进行制度创新。制度创新应遵循实质合理性和公正性、科学性和系统性、可操作性和有效性。

The essence of the institution consists in its form rationality and the substance rationality. It has such main functions as the nature of criterion and order, rationality and validity, the nature of guidance and restriction, harmony and conformity and so on.When the form rationality of institution is contradicted with the substance rationality, it will be disabled in configuration and function. As a result, the innovation of the institution is needed. The innovation of the institution must follow such principles as the substance rationality and impartiality, the nature of science, to be manipulated and validity, science with the system, advancing gradually in due order and so on.
