论器官移植供受体生命健康权的法律保护

On Legal Protection of Healthy Right of Transferee and Transferor in Transferring Organs

器官移植是一项具有较高技术难度的手术,手术的风险性很大,加之可供移植的器官来源又严重不足,医疗实践中极易发生侵害供受体生命健康权的情形。为此,需要立法采取相应的对策,如禁止人体器官买卖、供受体双方充分知情同意,建立供受体健康状况调查、器官移植对供受体健康的影响评估、器官来源审查、器官移植手术许可证等制度,保护好进行器官移植的供受体双方的生命与健康。

Transferring organs is a difficult operation with high-technology,which is a dangerous operation ,and the source of it is limited ,so there will be a situation that the healthy right of transferee and transferor easily damaged in medical practice. For we need take auordingly countermeasures by legislation ,to protect the health and life of two sides eg. to forbid selling organs ,to get agreement of tranferor and transferee, to build health lnvestigation of two sides ,examining the effect for the health of two sides, Checking up the source of organ, certificating License of transferring organ etc.
