摘要
通过运用民法和物权法的基本理论和原理并结合中国的现状对建设工程价款优先受偿权的法律性质、特征、取得、效力和实现问题加以解析、评判,提出立法建议,以期对完善这一领域的法律制度和房地产市场的健康发展有所裨益。
By applying the basic theories and principles of the civil law and the real right, the article presents a discussion of the domestic actuality regarding the priority of being repaid in construction projects in view of its legal character, effectiveness and realization. Moreover, it offers some helpful resolution, judgment as well as suggestions of legislation in order to perfect the legal system within the field for the sake of healthy development of real estate market.
