互联网的发展和电子商务活动的开展使得商业秘密的产生过程、表现形式和物质载体等都发生了巨大变化 ,但也使商业秘密处于岌岌可危状态之中。有必要对网络环境下侵害商业秘密的行为作一探讨 ,修改我国有关商业秘密保护的法律 ,适应网络传输给商业秘密保护带来的新课题 ,促进我国商业秘密法律保护制度的完善。

With the development of Internet and electronic business affairs, many great changes have taken place in the procedure of trade secret, its material carrier and its form at the same time the trade secrets of an enterprise have been disclosed or endangered. So it is necessary to analyze the characteristics of infringing on trade secret rights under network environment in order to help protect and perfect our trade secret law.
