摘要
近世“人”的发现为近代中国思想家们接纳源于西方的“权利”概念提供了必不可少的思想基础和条件 ;“公理”世界观的确立则为近代中国思想家们把握正当性意义上的“权利”观提供了信念支撑和基本的理论前设。而这两者均为儒家思想文化自身内在演变的逻辑结果。长久以来 ,视传统文化为近代中国“权利”精神生长的纯粹阻碍因素的论断 ,值得学界重新审思。
The rediscovery of 'humanity' in the modern history of the world has laid an indispensable foundation and a necessary condition for the thinkers of modern China to accept the concept of 'right' which derives from the western countries ,while the establishment of the viewpoint of 'just' has provided a belief support and a basic theoretical premise for the modern thinkers accepting the concept of 'right'in a justifiable sense.The afore-mentioned two things are results out of the interior logical evolution of the Confucian culture and ideology.
