论鉴定结论的运用与鉴定制度的规范

On the Application of Expert's Evaluation and the Standardization of the Evaluation System

鉴定结论在我国司法运用中存在很多问题。我国对鉴定结论进行规范与完善 ,首先应设立科学的鉴定制度 ,包括确立鉴定的等级制度、鉴定的终局制度和鉴定的程序规范 ;其次应规范鉴定结论证据效力运作的诉讼制度 ,包括要明确鉴定结论属当事人举证责任 ,规范鉴定结论审查的庭审程序 ,明确对鉴定结论进行审查的实体内容和建立鉴定证据制度有效运作的保障机制。

On account of many problems existing in the application of expert's evaluation in China, it is time to regulate and improve the evaluation system. This author suggests that there should establish a scientific system of expert's evaluation, including building a degree system of evaluation, the conclusion system and that of procedural criterion; and furthermore, measures should be taken to regulate the procedural system of the operation of evidence effect.
