品格证据规则研究

Study on Rules of Character Evidence

品格证据规则作为证据法学的重要内容 ,并没有得到我国证据法学界的应有的重视。事实上 ,品格证据具有逻辑上的相关性 ,只是可能带来推理性偏见和伦理性偏见。英美法系国家的立法和判例较为合理地解决了这一冲突 ,值得我国借鉴。

As an important part of the law of evidence, the rule of character evidence has not been paid enough attention. In fact, character evidence has some logical relevance, though they may bring reasoning prejudice and moral prejudice. In Anglo-American legal system, this conflict has been resolved reasonably, which provides good experiences for Chinese practice.
