On the National Treatment Principle of TRIMs and Its Application

TRIMs协议以多边协议的形式将GATT中的国民待遇原则引入了国际投资领域 ,但由于对TRIMs协议中国民待遇原则存在模糊的认识 ,造成理论和实践中产生对国际投资领域国民待遇和国际贸易领域国民待遇的混淆。具体分析TRIMs协议国民待遇的产生和性质 ,明确其非投资待遇的性质 。

TRIMs introduced the national treatment principle of GATT, in the form of multilateral agreement, to the international investment area. However, the ambiguous cognition of national treatment principle of TRIMS leads to a confusion of the national treatment in international investment area with the one in international trade area both theoretically and practically. With a specific analysis of its causes and traits, a clear definition of its non-investment treatment nature, it will be greatly beneficial to our better cognition and application of the national treatment principle of TRIMs.
