少数民族法制现代化及其本土资源保护

Legal Modernization and Native Resource Protection of Minorities

中国法制现代化应该包括少数民族法律文化的现代性转型,然而由于少数民族法律的特殊性,我们在进行其现代化的进程中必须始终关注其本土资源的优化和配置。我们从分析法制现代化的一般原理入手,借用法制现代化的发展模式的分析思路,对少数民族法律的转型进行比较研究,指出在民族民间法向现代型法律的转化过程中必须重视保护其本土资源。

The legal modernization of China should contain the legal modernization of the minorities. However, because of the specialty of minority laws, we must keep paying attention to the better allocation of their native resources. This article begins with the analysis of the general principles of legal modernization. The author analyses the development model of legal modernization, makes a comparison and research about the alteration of minority laws, and points out that the native resources should be protected when the minority laws are changing into the modern laws.
