论自治条例的性质

On the Features of the Self-governing Law

自治条例是民族自治地方全面调整自治事务的总章程。民族区域自治法公布实施以来,围绕自治条例性质的评论和争议一直没有中断,这也是制约和影响五大自治区自治条例出台的重要因素之一。本文从两个方面论述了自治条例的性质,认为自治条例具有法规性和法律性,是法规性与法律性的有机统一。

Self-governing Law is the general regulations that regulate the governing affairs in the autonomous regions. However, arguments have been raised continuously since the self-governing law was put into effect. This is one of the factors that restrict and affect the formulation of the self-governing regulations for the fire autonomous regions. The article intends to state in two aspects the features of the regulations and proposes that the self-governing regulations function both as decrees and law and are an intrinsic entity.
