论适合我国国情的鉴定主体资格模式

国际上鉴定主体资格主要有两大体系 :鉴定人原则和鉴定权原则。这两大体系各有利弊 ,各国法学界都在寻求更为合理的鉴定主体资格模式。当前我国鉴定主体资格模式主要以鉴定权原则为主 ,但在司法实践中 ,暴露出越来越多的问题和弊端 ,急需寻求一种适合我国国情的鉴定主体资格模式 ,以便能够科学、客观、公正。

There are mainly two systems of subject appraisal in China: the principle of appraiser and the principle of appraisal right. The two systems have both advantages and disadvantages and every country is seeking to find more reasonable modes of subject appraisal. At present time in China, subject appraisal follows the principle of focusing on the right of appraisal, only to find more and more problems and drawbacks in judicial practice. So it is necessary and emergent to find the mode of subject appraisal conforming to the national conditions of China to ensure a scientific, objective, impartial and lawful judicial testimony.
