摘要
分析了目前我国公立高等学校的法律定位以及这种定位的缺陷 ,并在介绍两大法系主要国家公立大学法律地位或立法趋势的基础上 ,得出应将我国公立高等学校定位为公法人这一结论。
The definition of China's public colleges and universities and the defects of this definition at present are analyzed. Based on the legal status or legislative trend of public colleges and universities in some major countries and regions of the two legal chains, we come to the conclusion that China's public colleges and universities can be defined as public juristic person.
