对坚持公安机关刑事鉴定体制的若干思考

Some Ponders over Sticking to Crimin al Identification System of Public Security Organs

在刑事鉴定制度的改革中,应该坚持公安机关的刑事鉴定体制。这不仅是因为坚持公安机关刑事鉴定体制有其法律根据,而且更重要的是因为坚持公安机关刑事鉴定体制,是刑事司法实践的迫切需求,有利于实现刑事诉讼的任务。同时,应通过立法完善公安机关刑事鉴定体制,如规范鉴定人的资格认证,明确其权利义务和法律责任,规范鉴定程序,克服“自侦自鉴”等缺陷。

In criminal identification system reform,we should stick to criminal identification system of public security organs.This is not only bec ause it has its legal bases,but also b ecause it is the urgent requirement of criminal judicial practice.It helps to realize the duty of criminal lawsuit.We should overcome 'selfinvestigation,self identification'by perfecting criminal identification system of public security organs.for example,standardizing qualification attestation ofidentifier,defirningits rights,duties and legal responsibilities,normalizing identification procedures.
