摘要
作者在比较了中国传统政治哲学中的"以人为本"和西方哲学中的"人文主义"的差异的基础上,探讨了"以人为本"的发展观对中国法哲学的影响,提出人应当是社会主义民主与法制建设的首要前提、根本依据和最终归宿。
On the basis of comparison between influences exerted by the 'Human - based Theory' of China traditional political philosophy on Chinese legal philosophy and that by humanitarianism in the westem philosophy on western jurisprudence, the author discusses the impact that the human - based development view has made on the change of China legal philosophy and proclaims that the human being should be the principal premise, the fundamental criteria and ultimate destiny of socialistic democratic and legal construction.
