摘要
我国现行夫妻财产法律制度存在夫妻财产法律体列结构的零散、法理逻辑欠妥、立法预测不够、内容有所缺失等问题。应增设婚姻关系续存期间夫妻财产分割的规定;赋予夫妻财产约定制的可操作性;设立夫妻财产告知义务;规定夫妻共同财产管理制度;建立夫妻财产转化制度等内容。
The author talked about the development experience of man and wife property legislation, set forth the guiding ideology for the man and wife property legislation. At last, the author pointed out some rationalization proposals for the man and wife property legislation.
