西方民主治理模式下存在着民主决策规则、公民经济社会权利平等、政府权力之限制及多元组织运作等诸多问题。为克服这民主治理模式内在的缺陷,西方学界从宪政制度设计的高度进行了思索。这对于中国当前转型期的治理具有重要启示意义,我们需要从立宪的高度进行制度建设。

There are many plights such as democratic rule of making-decision, equation of citizens' economic and social rights, constraint of government power and plural organizations under western democratic governance. In overcoming those above, the academic circle of the western comes up with some reflections on institutional designs, from which we learn that the constitutional institution design is the key to the governance of China during the transformation
