我国法定继承制度的立法构想

Legal Conception of Chinese Legal Inheritance System

值此我国《继承法》正在讨论修改之际 ,本文分析了我国法定继承制度存在的不足 ,借鉴国外立法经验 ,结合我国实际 ,试拟法定继承制度的立法建议稿 ,并对立法理由予以分析说明 。

While Chinese Inheritance Law is in the hot discussion for its correction and improvement, we offer this legislative proposal on Chinese Legal Inheritance System, focusing on the defects in the present inheritance system as well as our experiences and learning from the foreign legislative practice. In addition, we have enplaned and analyzed the legislative grounds. We hope that this paper will work as something worthy to the legislative body.
