中国社会主义建设与法治的关联是随着中国改革开放而逐步形成的。1956年社会主义改造结束至1978年十一届三中全会以前是中国社会主义建设与法治分离的时期,十一届三中全会到1995年十四届五中全会是中国社会主义建设与法治关联的准备时期,十四届五中全会标志着社会主义法治时代的到来。社会主义法治仍存在着严重危机,改革重心应从经济体制改革转向政治体制改革。
