WTO框架下中国国际商事仲裁的改革发展与创新

The Development of Reformation and Innovation of Chinese International Business Arbitration under the Frame of WTO

WTO框架下,我国全方位、宽领域、高层次的对外开放格局基本形成,仲裁机构理应适应形势、更新观念,向国际水准看齐,进一步走向世界,这是一项极富挑战性和探索性的工作。笔者从WTO框架下中国国际商事仲裁制度的国际化法律特征;对仲裁的客观要求;仲裁的改革和创新等三个方面阐述了WTO框架下中国国际商事仲裁的改革发展和创新。

Under the frame of WTO, the basic pattern of opening the door on every side, in even wider field has formed. It is indeed a challenging and exploring work for the arbitration organization to fit in with the situation and renew its ideas in order to meet the international standard.The author illustrates his viewpoint from three aspects:under the frame of WTO, the internationalized law characteristics of Chinese international business arbitration, objective requirement of the arbitration, the reform and innovation of the arbitration.
