在法治所寻求的诸多价值中,自由是法治的核心价值。这源于人是自由的存在物。人的自由本性通过实践来展开,主体间的自由需要法律来调整。自由是法律产生的前提和基础,法律是自由的外化。法治运行的宗旨是保障自由的现实化,在法治价值目标序列中自由处于核心地位。
Among many values demanded by ruling by law, liberty is the core of the ruling by law. This results from man as a liberal existence. The liberal nature of man is developed by practice and the liberty between subjects needs to be adjusted by law.
