多元价值体系下的行政指导

Administrative Guidance under the Multi-Value System

对行政指导进行价值分析具有重要的理论和实践意义。通过研究,笔者认为行政指导作为一种制度与秩序、正义、自由、平等、效率五种价值有相同意趣:行政指导以建设稳定、普遍、和谐的生活秩序为基本出发点;它使行政机关和相对人在正义的旗帜下各得其所;行政指导具有促进积极自由和消极自由的双向功能,在具体指导过程中,私益与公益、选择与裁量能保持相对平衡;为实现公法状态下的平等,行政指导为相对人在地位、机会和结果三个不同的层面提供了切实的制度保障;行政指导与现代行政的效率原则也并行不悖,多种优势造就了行政指导高效、节省、全面、持久的效率模式。

It is significant to study the value of administrative guidance in theory and in practice. By studying, the authors argue that the administrative guidance follows the basic values, such as order, justice, freedom, equality and efficiency. The administrative guidance aimed to establish life order which should be stable, general and harmony. The administrative organization and relative parts should obtain its own parts that they deserve. The administrative guidance offers support to both positive and negative freedom in which the public and private interest ,the discretionary power and the selective rights will be kept in good banlance. In order to realize equality, administrative guidance satisfies the standard of equality in three aspects, position, opportunity and result. Finally, administrative guidance which has been developed by several advantages contains high-efficiency, cost-saving, allround and long-lasting institutional system of modem administration.
