关于完善我国外资立法的构想

Conception of Perfecting the Chinese Foreign Investment Legislation

为了建立科学、统一、先进且符合国际投资自由化发展趋势的外资立法体系 ,我国应当制定统一的外资法 ,重构外资立法体系 ,对现行外资立法与《公司法》不协调的内容、外资立法中不符合WTO规则的内容。

In order to set up a scientific, unified,advanced foreign investment legislation system which may tally with the developing trend in foreign investment liberalization, China should constitute a unified foreign investment law, rebuilt the foreign investment legislation system and perfect the content that disagree with Company Law or WTO legal system, meanwhile perfect other branch laws and the content that may lead to problems.
