摘要
公职人员职务的法律保障是其权利保障中最重要的组成部分之一,对廉政建设具有十分重要的意义。然而,我国当前公职人员职务保障的现状却昭示了制度方面的缺陷,主要表现在公职人员职务保障法律制度的不完备和缺少司法救济,并由此造成了种种问题。这些问题的存在对廉政建设产生了极为严重的负面影响。因此,只有确保公职人员有稳定、全面的职务保障,才能减少用人腐败产生的可能性,从而可以有力地推动廉政建设的进一步发展。
Being very important to the construction of a clean-and-honest administration, the le-
gal protection of the jobs for the governmental employees turns to be a weighty part of the guarantee on
their rights. Yet the present practice makes clear some institutional defects: the imperfection of the le-
gal systems in this respect, the lack of judicial aid and the problems thus brought about. They cast a
very bad impact on the construction of an incorrupt politics. Therefore, a job guarantee may help to
reduce a possible corruption in personnel appointment so to better the government administration.
