摘要
疑难案件中存在着法律解释的"疑难",作为法律解释者的法官必须以利益衡量和价值判断为指南进行法律解释活动。利益衡量和价值判断是对疑难案件中的利益冲突所做的价值评价和价值选择,它们决定着法律解释方法的选择。
Difficult cases are so called for difficult legal accounts, which depend solely on the responsible judges in perspectives of beneficial balance and value criteria. Hence, beneficial balance and value criteria are decisive to choice of the legal accounts of difficult cases.
