论依法行政的民主基础

On the Democratic Foundation of Administrating by Law

经济上自由化,政治上民主化,是现代行政法治实现的两个基本前提。没有民主就没有社会主义,没有民主也不可能实现依法行政。民主化程度直接决定和影响着行政法治的实现程度。因此,实现依法行政必须建立民主基础。社会主义民主的本质是人民当家作主,国家一切权力属于人民,实行民主选举、民主决策、民主管理和民主监督,保证人民依法享有广泛的权利和自由,尊重和保障人权。社会主义民主的这一本质特征要求行政机关的行政管理贯彻行政民主原则。

The liberalization of economy and the democratization of politics are two basic hypotheses to realize modern administration ruling by law. No democracy,no socialism. It is impossible to realize the administrating by law without democracy. The degree of the democratization directly determines and affects the degree of realization of the administration ruling by law. The administrating by law has to construct the foundation of democracy. The entity of the socialist democracy is that the people take charge of the nation; ail rights of the nation belong to the people; and the nation should democratically implement election, decision;administration and supervision;it should also guarantee the people to enjoy extensive rights and liberty,to respect and to ensure human rights. This characteristic of the socialist democracy requires the administrative board to carry out the principle of democracy in the course of the administration.
