论劳动教养所外执行的难点与对策

On the Difficulty and Strategy of the Enforcement outside the Laboring Penitentiary

当前,劳动教养所外执行存在适用条件过于原则,任意性过大;监管力量不足,措施不力等主要问题。做好劳动教养所外执行管理工作必须制定和完善所外执行的工作细则;严格限制适用对象和范围;建立保证金制度;改善执行方式,建立环环相扣的管理责任制。

There are some major problems in the current enforcement outside the laboring penitentiary: the applied condition is too dependent on the principle and too arbitrary, the power of supervision is insufficient and the measure is not effective. In order to do well the administrative work of the enforcement outside the laboring penitentiary, it is required to lay down and perfect work rules of the enforcement, strictly limit the applied object and scope, set up the bail system, improve the enforcement means, establish the responsibility system of the administration in a mutually linked way.
