摘要
作者认为,基于以下四种理由:１９９９年ＷＴＯ争端解决机制(ＤＳＢ)的专家组裁定３０１条款与ＷＴＯ规则相一致;过去十余年,３０１条款针对中国所特有的经验;中美关于中国入世协议的苛刻及中国自身面临的问题;美国针对中国的咄咄逼人的战略。由此,３０１条款在针对中国时会被强化,甚至演变出专门针对中国的包含多种审查和制裁措施的“中国３０１”机制。
In l999, the expert team of DSB ruled thatArticle 301 is in conformity wilh WTO regulations.Over the past ten years, ArIie1e 301 has been usedto the disadvantage of China. This fact, coupledwith An1erica's containment strategy against Chi-na, should alert us to the possibility that Article30l would be intensified in the future to the extentof becoming an' anti -- China 301' mechanism inthe Sino -- US trade.
