摘要
分居制度属于婚姻法律制度的重要组成部分 ,香港的婚姻法对分居制度进行了较为详细的规定。目前 ,我国大陆婚姻立法中有关分居制度还不完善 ,应积极借鉴香港的分居立法经验 ,对我国大陆分居制度的形式、程序、条件、法律后果以及分居与离婚的关系等内容进行立法 。
Separation system is one of the most important parts in the legal system of marriage,and it has been specifically regulated in Hong Kong's Marriage Law.At present,separation system in mainland marriage legislation is not perfect yet,and should be regulated from the aspects of form,procedure,condition,legal consequences and the relationship between separation and divorce using Hong Kong's experience as reference,so that marriage legislation in China's Mainland can be consummated.
