摘要
公务员惩戒制度就是对于公务员在执行公务过程中的违法违纪行为,给予行政上的惩罚以示警戒的制度。其本质是对国家公务员的行政制裁,是一种内部行政行为。外国公务员惩戒制度的主要内容包括惩戒的条件、惩戒的形式、惩戒机关、惩戒程序和不服惩戒的救济。外国公务员惩戒制度比较一致的特点有:惩戒条件的概括性、惩戒形式的多样性、惩戒机构的双轨制和惩戒程序的严格性。对我国而言,外国公务员惩戒制度值得借鉴的经验有:公务员惩戒制度应高度规范化;权、责、罚相适应的规则体系是合法惩戒的根本;宽严适中、层次分明的惩戒条件和形式是合理惩戒的重要条件;完备严格的程序是惩戒发生预期作用的保障。
This paper definites the disciplinary system of civil servants as the system,which disciplines the civil servants who break administrative law or violate discipline in performances of official business as warnings.Its essence is a sort of internal administrative sanction against civil servants.The disciplinary system of civil ser - vants abroad covers the disciplinary condition,disciplinary form,disciplinary body,disciplinary procedure and remedy.The disciplinary systems abroad have common characters:the conditions are summary,the forms are par - ticolored,the governments practice double - track disciplinary body and the strict procedure.There is much in their experience that we can make use of.
