论前燕的法制

On the Legal System of Former Yan Dynasty

前燕是十六国前期影响较大且较为强盛的一个政权。前燕统治者都具有较高的汉文化素养。前燕的法制原则:前期法简刑慎;中后期法峻刑严。前燕除承用晋制外还制定了一些法律制度:选官方面,多途径罗致人才;经济制度方面,开园苑,定税制,罢荫户;刑事法规重点打击危害君主专制、破坏经济制度的行为。前燕的司法机构相对健全,注重司法官的选派。

Former Yan Dynasty was an influential,strong and prosperous regime in the early stage of the Sixteen Kingdoms.All of the early dominators were equipped with much higher Sino-civilization accomplishment.The law was simple and the penalty was prevailing in the early stage while the law was harsh and the penalty was stern in the mid-later stage.Besides succeeding to the advanced system,the dominators also constituted some laws and regulations.In the aspect of official selection,men of ability were reeruited in various ways. In the aspect of economic system,manors were originated;tax system was established and families under shield were ceased;and the main attention of criminal penalty was paid to take strong measures against the behaviors of jeopardizing autocritical monarchy and demolishing economic system.With a relatively sound judicial institution,Former Yan Dynasty paid much more attention to the designation of law officers.
