论公务员的“服从义务”与有限审查权

On "obeying the obligation" and examining right limitedly of the civil servant

本文从特别权力关系的理论与依法行政的理念等视角探析了公务员与国家之间的特别权力关系:原则上,公务员具有服从上级命令的义务;另一方面公务员又对该命令的合法性享有一定的审查权。

From the perspective of special power relation in theory and idea that administare according to taw ,etc. this arcteile analyses special power relations between civil servant and their state: in principle, the civil servant obeys the obligation from higher authorities order; he endows certain examination right to the legitimacy of this order on the other hand.
