随着人类的进步和社会的发展,刑罚愈来愈体现出人道性色彩。在我国的法制进程中,刑罚的人道性主要表现在限制、减少死刑,文明死刑执行方式;进一步改革未成年人犯罪的刑事责任;完善正当防卫制度;保留并更加重视管制刑;扩大罚金刑的适用等五个方面。

With the improvement of the humanity and the development of the society, the punishment has become more and more humane. In the progress of the legal system in our country, the humanity of punishment mainly gives expression to the following five aspects: they are the confinition or reduction of the death penalty, the civilization of the way to carry out it, consummating the criminal responsibility of the crime of the adolescent, furthermore we should perfect the institution of legitimate defense, reserve and pay more attention to control penalty, and enlarge the domain of the forfeit.
