关注后制宪时代的中国宪政——学习新宪法修正案的若干体会

On the Constitutional Government in the Constitutional Era

人权保障、私有财产权的保障是本次修宪的两大法治亮点 ,彰显了共和国宪法日趋成熟的宪政文明和法治文明。全社会在关注文本上的宪法修改的同时 ,更要关注制度层面的宪政建设。随着“国家尊重和保障人权”的规定入宪 ,“人权”将成为约束公民权力的“关键词” ,中国的人权保障事业将进入一个新时代。人们将更加关注人权入宪后的具体的法治实践———尊重和保障人权的宪法承诺如何落到实处。“公民的合法的私有财产权不受侵犯”等规定的入宪将开辟私产保护新时代 ,国家立法机关应对相关法律进行一次全面的清理 ,补充、修改并完善有关保护公民财产权的规定。通过渐进式的宪政建设切实维护宪法的权威 ,为在全社会实现公平和正义提供权威的宪政保障 ,依然是“后制宪时代”

The guarantee of human rights and the right of private property are the two most striking points in this amendment of the Constitution,which suggest the constitutional government and the running of the society by law are becoming increasingly mature.The whole society should pay close attention not only to the amendment of the constitution,but also to the construction of the constitutional government especially in the making of institutions.With these two entries entering the Constitution,a new epoch which ensures the human rights and the right of private property has come.The legislature of the country should take advantage of this opportunity to remove the outdated,add the vacant,and revise the improper so as to ensure the authority of the Constitution and guarantee the justice and fairness for everyone.
