摘要
文章通过对劳动法及劳动部有关规章的分析,提出劳动法并无歧视农民工的内容,造成农民工权益受侵犯的主要原因在于司法过程中出现扭曲、行政规章中有不合理的规定。因此政府应转变观念,废除不合理的规章制度,建立农民工劳动权益维护的畅通机制。
On analyzing the Labor Law and related regulations issued by Labor Department, the article concludes that no contents discriminating farmer worker exist in the Labor Law. The main reason for the violation of farmer worker's labor rights and interests is the distortion in the judicial procedure and some unreasonable articles in administrative regulations. Therefore, the government should change its ideas, abolish unreasonable laws and regulations and establish an unimpeded system for protecting farmer worker's labor rights and interests.
