对宪法价值的探讨

On the Value of Constitutional Law

宪法作为国家根本法,其价值有一般与个别之分。宪法价值具有与一般法律价值的共同性,但作为法律价值的一个部分或特殊表现形式,必然有其不同于其他法律价值的特点,具体体现为:原则性与概括性,适应性与广泛性,国家性与权威性,配补性与适用性。同时,宪法也有正义、自由和秩序价值,其中正义是宪法的内在价值,而自由与秩序则反映宪法的现实价值。

As the basic national law, Constitutional Law has the general value, which represents the same characteristics with general laws; and the specific value, which is different from others laws on the aspects of its principled and generalized features, adaptive and extensive features, national and authorized features, supplementary and applicable features. Constitutional Law is also provided with the values of justice, freedom and order, among which justice acts as its inner value and freedom and order as its real values.
