摘要
现代司法理念与法律文明的发展赋予司法公正新的涵义--以实体与程序的和谐统一实现法律所追求的公平与正义。为实现司法公正,亟待构建制度保障体系,即以法律自治与司法独立为基础实现公正、以实体与程序的公开为形式促进公正、以司法效率的提高为目标保障公正,以合理的制度设计保障司法的真正意义上的"公平"与"正义"。
Modern judicial concepts and the development of the judicial civilization give the justice newmeaning--entity in harmony with procedure can realize the fairness and justice that the law pursues.It is imperative to establish the system that can guarantee the realization of justice.
