近代的个人权利本位观、现代的社会权利本位观都存在很大缺陷,发展权由于自身具有的优势,决定其应成为当代法制保障的重点对象。文章同时提出了发展权法制保障的基本原则:平等性保障原则、权力能动性原则、尊重生态自然的原则。

There are great defects in the selfish departmentalism of personal rights in modern society as well as in the selfish departmentalism of social rights in the contemporary age. With its own advantages,the right to development should become the focal point for present legal guarantee. Thus the author poses the basic principles of the legal system of the right to development: equal guarantee,dynamic nature of the right, and respect for ecological nature.
