摘要
我国特有的劳动教养制度,因其立法上的粗疏,一直受到学术界和实务界的质疑。但如果简单地废除该制度,又会使我国的法律制裁体系出现空档。因此,现应从立法上进行重构,将劳动教养的性质定位于行政处罚;改变现在的适用对象,同时设立“劳役抵债”制度,一并纳入劳动教养;法定审批机构和程序,将劳动教养委员会改良为仲裁委员会模式,比照简易诉讼和仲裁方式进行行政审批;改革管理方式,实行开放式管理,设立脱逃终身追究等防范措施,充分体现劳动教养的行政性,发挥其应有的功能价值。
Because of the careless law,Chinas system of reeducation through labor has being doubted all the time by academic circles and practical circles. However,if we abolish this system simply,it will make blank in our legal sanctions system. So, we should rebuild and define it administrative penalty,change the object at present,set 'lab our debt' system at the same time,then put into labor education,legalize the procedure for examination and approval, change the labor education committee to the model of arbitration committee, reform the management way, carry out open management and so on, embody the labour education administration and exert its function value.
