近年来,医疗纠纷案件数与索赔额均呈上升趋势。2002年《关于民事诉讼证据的若干规定》与《医疗事故处理条例》的实施,扩大了医疗机构及其医务人员的法律责任;因密切接触患者、药品及医疗器械,医务人员生命健康安全受到多种职业性危害,且这种危害日趋严重。社会的、法律的、医学的各种环境因素导致医疗执业风险增加。过高的医疗执业风险势必对医疗卫生事业产生一系列负面影响。有必要通过立法建立健全医疗职业保险制度,完善医疗风险社会承担机制,改善医疗执业环境。

In recent years, there have been increasing numbers of lawsuits on medical dispute and increasing sums of counterclaims. The implementation of Several Regulations on Evidence in Civil Actions and Regulations on Malpractice has enlarged the legal responsibility of medical institutions and medical workers. The health of medical workers is endangered due to their constant contact with the patients, medicines and medical equipment. Social, legal, medical and various environmental factors have increased the risks of the medical profession, which is sure to exert negative effect on the cause of public health. It is necessary, through legislation, to strengthen medical insurance system, perfect the society undertaking system for the risks in the medical profession and improve the working conditions for the medical workers.
