摘要
作为物权的房屋产权,是民事主体依法对房产占有、使用、收益和处分的排他性权利。但是,作为住房制度改革、房屋商品化产物的“房改房”,由于历史和现实的原因,其产权却存在一定缺陷,是一种不完整的物权。为了适应房改房产权社会化和市场化的发展方向,必须对其进行物权制度、产权政策和交易市场等方面的补救,使房改房产权成为完整的物权。
Reformed housing” is the result of reforming the housing system and commercializing houses.Because of the past and present reasons,its property right is an incomplete real right,in which exist some faults.In order to conform to the development direction in socializing the property right of “reformed housing”and making it marketable,we must remedy its faults through the real right system,the property right policy and trade markets,so that the property right of “reformed housing”may become a perfect real right.
