环境法与主流法的规范衔接和协调问题

On the Link and Harmony between Environmental Legal Regulations and Thaditional Legal Regulations

环境法规范分为基础性规范和派生性规范 ,其效力要么来源于主流法规范 ,要么能被主流法的价值目标所阐释。为了适应不断发展的客观形势 ,解决现实的环境问题 ,基于调整和保护对象的共同性或相关性及在调整机制方面的同一性或衔接性 ,环境法规范需要在技术层面甚至原理层面与主流法规范通过派生或阐释的方式衔接和协调。这两个层面的派生或阐释工作不仅促进了主流法规范的丰富和发展 ,还夯实了环境部门法的独立基础。

Environmental regulations can be divided into basic regulations and derived regulations.Their force comes from regulations of main departmental laws or can be interpreted by legislative goal of main departmental laws.In order to fit social developing demand and solve actual environmental problems,based on common or relative regulating objects and protecting objects,and based on the same or jointed regulating mechanics,environmental legal regulations need to be linkted or harmonized with regulations of main departmental laws by the methods of derivation and interpretation.Derivation or interpretation in these two levels not only promote the development of special regulations of traditional law,but also tamp self governed base of environmental departmental law.
