摘要
笔者在论述计算机犯罪概念的基础上,指出其犯罪主体既有一般主体,也有特殊主体,侵犯的是复杂客体,既可由故意,也可由过失实施计算机犯罪的作为或者不作为两种行为。
On the basis of describing computer crime concept,the author points out that: firstly, its subject includes general subject and special subject, and what it has infringed is complicated object;secondly, it can be implemented by on purpose or by fault, and the conduct of the crime is action or omission.
