论我国现行海外投资立法的不足和完善

The Disadvantage and Development about the Overseas Investment Legislation of China

随着经济的发展,我国海外直接投资迅速扩展,但我国现有的有关海外投资的立法存在严重不足,有必要在坚持有利于我国经济发展、倡导和监管相结合以及与国际法一致的原则的前提下,建构一个以《海外投资法》为根本法,以《海外投资外汇法》等诸多配套法为补充的、系统的法律体系。

With the development of our economy,the overseas direct investment of China has been boosted rapidly.In China,there is no perfect legislation concerning the question.It is necessary to set up a legal system benefiting the economic development of our country,adapting our legal system to international legal principles and practices,and two key methods─drafting basic and serial law,harmonizing international treaty about the overseas investment legislation.
