摘要
通过比较分析英美法系和大陆法系国家商业秘密法律保护的理论基础与救济制度,建议我国对商业秘密法律保护应以财产权理论和公平竞争理论为基础,吸收禁令救济制度,引入惩罚性损害赔偿制度,以完善我国的商业秘密法律保护制度。
By comparing and analysing the theoretical base and helping system of the trade secrets of the British-American law and the Continental law,the article's suggestion is that the legal protection of trade secrets should base on the theory of property rights and fair competition to absorb injunction helping system and lead into punishment damage compensation system to improve the legal protection system of our country's trade secrets.
