摘要
我国现行知识产权法本就零散,加之修补,立法层多,使得相关法律法规不完善、不配套,甚至存在一定程度的矛盾,应参照国际经验,制定统一的知识产权法,并界定统一知识产权法的范围,将其作为一个独立的法律部门。文章对制定统一知识产权法提出整体设想,对制定技术提出建议。
The current intellectual property law of our country is originally scattered, and with revision, there are many legislative levels, which lead to imperfection and incomplete set of concerning laws and regulations, even contradiction in some degree. We should consult international experience to draft unified intellectual property law, stipulating the scope of unified intellectual property law, regarding it as an independent legal branch. This paper puts forward whole consideration for drafting unified intellectual property law, and makes a suggestion for the technology of enactment.
