关于经济学产权问题的法律思考

Legal Consideration of Property Rights of Economics

自 2 0世纪 80年代下半叶以来 ,产权这一概念在中国广泛使用 ,然而什么是产权、其与所有权的关系是什么却是国内外一直争论的问题。在剖析西方产权理论 ,阐述我国产权制度范畴内涵的基础上 ,本文对我国产权制度的选择提出若干建议 。

Since 1980s,conception of property right has been used widely in China.However,people have disputed at home and abroad over what is proper rights and what is its relation of ownership.Based on analysis of property rights' theory in the West and explaining connotation of property rights' rules,this paper puts forward some suggestions on choice of property rights' rules and emphasizes that it is a key by the law form to make company possess ownership of legal person which can straighten out property relation.
