摘要
优先权制度起源很早,许多国家在民法典中对优先权有专章规定。我国民法还没有设立优先权制度,随着我国物权立法趋于完善,优先权必将成为不容回避的问题。本文拟就优先权的概念界定、优先权的特点及其分类、立法现状及立法建议探讨构建我国物权立法中的优先权制度。
The priority system has a long history.Many countries have special regulations in their civil law chapters.Our civil law still haven't established the prionty system.With the development of legislation,the prionty system will be an inevitable question. This article will probe into establishing the priority system in our civil law from its concept-making,character,clasification and legislative suggestion.
