On Constitutionalism and Protection of Human Rights

本文以宪法、宪政与人权保护为主旨,从"应有人权"向"实有人权"转化、宪法保障人权的路径、宪法修正案对人权的规定等方面,论述了宪法、宪政与人权保护的一般关系。

This paper focuses on the relationship among constitution, constitutionalism and the protection of human rights.The author attempts to explore the common relationship among constitution, constitutionalism and the protection of human rights from the following aspects: the transition from humanrights as it should be to positive human rights, ways for constitution to protect human rights, and the provisions involving human rights in the new amendment.
